VGR wins major construction dispute against NCC

In May 2014, NCC took legal action against Västra Götalandsregionen, VGR, at the district court of Gothenburg, claiming approximately SEK 100 million in additional costs for the construction of a new forensic psychiatric ward outside of Gothenburg.

Through cross-action, VGR claimed SEK 16 million in liquidated damages due to delay of the works. The hearing lasted for 67 days and included expert testimonies from 26 experts and witness testimonies from 41 witnesses.

The district court delivered a judgment on 12 June 2019, rejecting NCC:s claims in full. The court also ruled for NCC to pay liquidated damages to VGR in the amount of SEK 11.5 million and fully reimburse VGR for its litigation costs.

VGR was represented by Mannheimer Swartling in the dispute.
