New case law – The Regulation on the Award ” For Zealous and Devoted Service of the Realm”

Question of whether the employment time or service time of reserve officers should form the basis for awarding the distinction “For Zealous and Devoted Service of the Realm.”

The Labor Court has concluded that there are special reasons according to the regulation (1974:225) on the award “For Zeal and Honesty in the Service of the Realm” (NOR regulation) to use service time instead of employment time for reserve officers as the basis for awarding the distinction. The Labor Court has further concluded that reserve officers are part-time workers according to the law (2002:293) on the prohibition of discrimination against part-time workers and workers with fixed-term employment, and that the state’s application of the award does not constitute discrimination under the law.

In the case, the special set-off provision in the Labor Disputes Act regarding legal costs has been applied.
