New case law – Review of the Legality of a Proposed Political Industrial Action with International Background

Interlocutory review of the legality of a proposed political industrial action with international background (blockade against military equipment to or from Israel). In such a review, it is incumbent upon the party intending to implement a blockade to at least make it probable that the effects on the employer’s management rights would be so minor that the proposed blockade would be permissible. Since neither party elaborated on the potential effects of the proposed blockade, the Labor Court deemed that a request for an interim order on the legality of the blockade could not be granted.
