New case law – Justifiable Reasons for Termination Due to Low Work Performance

An employee was terminated from their position due to circumstances that, according to the employer, were related to the employee personally and consisted of various deficiencies in the employee and the manner in which they performed their work. According to the employer, the termination was not related to the employee’s membership in a labor organization. The Labor Court found that the company had justifiable reasons to terminate the employee’s employment for personal reasons and that the employer did not violate the employee’s or the labor organization’s right to association through the termination.
