New case law – case concerning the right to special contractual pension for rescue services (AD 2026 no. 34)
The main question in this case is whether twelve employees of the Rescue Services Association in Gothenburg (RSG), who hold various management positions, have served in an emergency team unit and therefore are entitled to the special contractual pension for rescue services (SAP-R). The employees are or have been employed as incident commanders, regional incident commanders, officers on duty, or alarm and command officers.
The Labor Court has found, partly in light of what has been shown regarding the background and purpose of the provisions in the collective bargaining agreement regarding SAP-R, and partly through interpretation of the wording of the agreement, that only firefighters and unit leaders at RSG, i.e. not the management positions relevant in the case, are to be considered as serving in the emergency team unit under the provisions in the collective bargaining agreement regarding SAP-R.
