New Case Law – Summary Dismissal of police officer after data breach

A police officer who had been convicted of nine cases of unlawful data breach was dismissed. The searches in the Police Authority’s IT system were not work related and concerned the police officer’s half-sister’s partner. The Labour Court considered the searches to be such surveillance or mapping of the half-sister’s partner which the partner should be protected against in relation to the public under the Swedish Constitution. The officer was deemed manifestly unfit for duty and to have seriously breached her obligations. Grounds for dismissal were found.
