Stena wins challenge proceedings against Russian shipyard
Stena wins challenge proceedings in Svea Court of Appeal relating to a shipbuilding contract dispute with Baltiysky Zavod JSC.
In the challenge proceedings, stemming from an award of EUR 20 million in damages to Stena after arbitration proceedings held in Stockholm in 2008, Baltiysky Zavod’s claim before the Svea Court of Appeal was dismissed and the Court ruled that the shipbuilding contracts, including the arbitration agreements, had entered into force.
Enforcement proceedings in Russia were stayed by the Russian Federation Supreme Commercial Court (‘Arbitrazhny’) awaiting the outcome of the challenge proceedings in Svea Court of Appeal.
Stena has been represented by Mannheimer Swartling in the arbitration and challenge proceedings in Sweden, and the enforcement proceedings in Russia. The firm’s team is led by Fredrik Andersson and includes Hanne Aarsheim, Liubov Erigo, and Irina Selezneva.
