Stena wins enforcement proceedings against Russian shipyard
Swedish shipping company Stena RoRo AB has won enforcement proceedings against the Russian shipyard Baltiysky Zavod JSC and related nullification proceedings before the Russian courts.
In the enforcement proceedings, stemming from an award of EUR 20 million in damages to Stena RoRo after three consolidated arbitration proceedings held in Stockholm in 2008, Baltiysky Zavod’s objections against enforcement were upheld by the lower courts. However, on 13 September 2011, the High Commercial (“Arbitrazhniy”) Court reversed the decisions of the lower courts and declared the arbitration award enforceable in Russia.
The High Commercial (“Arbitrazhniy”) Court also tried a related action for nullification of the underlying shipbuilding contracts on which the arbitration award was based brought by certain shareholders in Baltiysky Zavod. The Court rejected the shareholders’ claim and ruled in favour of Stena RoRo.
