Dispute Resolution - Some recent cases in Arbitration

  1. Global Railway Group
    Counsel for a global railway group in ICC proceedings in Stockholm against an American based global railway group. The dispute concerned claims for damages under a license agreement for the production and sale of train brake equipment and violations of the Swedish Trade Secrets Act. The claim exceeded USD 100 million and included injunctive relief.

  2. Supplier of Products for the Engineering and Construction Industries
    Dispute regarding warranties, additional purchase price etc. in connection with the acquisition of a foreign company. Several arbitrations and challenge proceedings have arisen. The matter also includes court proceedings and other proceedings abroad.

  3. Delivery of Industrial Plants
    Counsel for a major Swedish construction company in ad hoc-arbitration in Stockholm in a dispute relating to claims for compensation for additions and alterations under a construction contract and counterclaims for replacement purchases due to cancellation of the contract.

  4. Counsel for Swedish Shipping and Passenger Vessel Provider
    Counsel for a global shipping and passenger vessel provider based in Sweden in SCC proceedings in Stockholm against a Russian shipyard and subsequent challenge proceedings before the Svea Court of Appeal and enforcement proceedings before the High Commercial Court of the Russian Federation. The dispute concerns damages for breach of shipbuilding contracts (anticipatory delay).

    On 3 November 2009, the High Commercial Court of the Russian Federation suspended its proceedings until the Russian company’s challenge has first been considered in Sweden; allegedly the first time a Russian court has suspended a case on the recognition and enforcement of an arbitral award until a foreign court has issued a judgment.

  5. Counsel for Swiss Media Company
    Counsel for a Swiss media company against a Swedish television network in parallel SCC proceedings in Stockholm and court proceedings in no less than 26 Swedish District Courts and subsequent enforcement proceedings. The dispute concerned television rights to certain Swedish sport events and subsequent requests for and enforcement of interim injunctions. The dispute has been successfully settled.

  6. Power and Automation Technology
    Counsel for an international industrial group of companies in the power and automation technology business in on-going ad-hoc proceedings in Stockholm against a Swedish and a Polish company. The dispute concerns claims for compensation under an agreement regarding delivery of power transformers.

  7. Water and Wastewater Closed Joint-Stock Company
    Counsel for a Moscow based distributor of technical equipment in ICC proceedings in Paris against a Swedish manufacturing company. The client is a leading distributor on the Russian market and the opponent is a leading global manufacturer part of a US based high-technology engineering and manufacturing business. The dispute concerns claims for damages under a distributor agreement and includes allegations of corruption and money laundering, giving rise to several issues concerning both domestic and foreign anti-corruption and anti-money laundering legislation as well as international conventions and treaties.

  8. Insurance Dispute
    Counsel for a Danish insurance company in SCC proceedings in Stockholm against an international bank based in Sweden. The origin of the dispute is the breach of a warranty under a share sale and purchase agreement. The settlement was concluded on terms highly favorable to the client.

  9. Dutch Construction Company
    Counsel for the claimant, a Dutch construction company in SCC proceedings in Stockholm against a multinational manufacturer of building products. The dispute relates to faulty design of a tank system provided under a license agreement.

  10. Insurance Dispute
    Counsel for a Swedish insurance company in arbitration against two reinsurance companies (one Swiss and the other German). The dispute concerned whether or not the insurance company had reinsurance cover for its life insurance portfolio. At the time, the client was under close scrutiny of the Financial Supervisory Authority and a negative award would have threatened the company’s entire existence and would also have had possible dire consequences for many individual life insurance policy holders. The award from last year was a great success for our client.

  11. International Energy Group
    Counsel for an international energy group. Arbitration under the ICSID Arbitration Rules regarding violations of the Energy Charter Treaty. The dispute concerns measures imposed on a coal-fired power plant. This is the first publicly disclosed claim against a Western European state under the Energy Charter Treaty.

  12. Oil and Gas Exploration
    Lead counsel for the claimant. Arbitration under the SCC Rules. The dispute concerns the validity of a Hydrocarbons Sharing Agreement, concerning deep water exploration of part of the Black Sea, which the parties entered into in 2007.

  13. Counsel for Global Industrial Group
    Counsel in SCCarbitral proceedings over allegedly faulty deliveries of bearings for the pod-propulsion systems of a number of cruise ships. After the exchange of some initial submissions, the case was withdrawn by the opposing side without prejudice to their right to re-file their request for arbitration at a later date.

  14. Global Investment Company
    Counsel for a global investment company based in Western Europe against a hedge fund based on the Cayman Islands and its investment manager. The dispute concerns claims for repayment of a redemption fee charged by the hedge fund.

  15. Global Chemical Group
    Counsel for a global chemical group based in Western Europe in SCC proceedings in Stockholm against a Chinese chemical company. The dispute concerns claims for damages under an agreement regarding technology licenses for the construction and operation of a chemical industrial plant in Shanghai.

  16. UNCITRAL Proceedings
    Counsel for a major Russian oil refinery in UNCITRAL arbitration proceedings in Stockholm brought by a U.S. company. The dispute concerns claims for repayment in an amount of USD 27 million under an agreement for the delivery of diesel and fuel oil.

  17. Energy Charter Treaty
    Counsel for a European state in an investment arbitration under the Energy Charter Treaty and the UNCITRAL Arbitration Rules. The claimant is a French energy company. The firm was selected to represent respondent after winning a public tender together with another law firm in competition with a number of international law firms.

  18. Chinese Telecom Group
    Counsel for a Chinese telecom group in an arbitration in Switzerland under the SCC rules. The dispute concerns the right to compensation under an agency agreement relating to the Albanian telecom market.

  19. Counsel for Leading Airline Company
    Counsel for an airline company in an arbitration in Paris under the ICC rules. The dispute arises out of a travel agency agreement in Saudi Arabia governed by Saudi Arabian law.
